Laser Expert Witnesses
What is a laser expert witness?
Depending on the target technology and product, laser expert witness candidates typically have advanced degree, extensive experience and areas of expertise in electrical engineering, optical engineering, physics, materials engineering, and/or mechanical engineering. If the case involves a medical expert, board certified specialists in reconstructive surgery, dentistry, ophthalmology, or dermatology may be called in. A chosen expert witness may be a member of an industry organization such as The Laser Institute, The American Society for Laser Medicine and Surgery (ASLMS), and/or the IEEE.
What types of cases require a laser expert witness?
A laser expert could provide expertise in intellectual property matters — a patent litigation in federal court or a trade secrets dispute. It could be a patent infringement case in the District Court, an Inter Partes Review (IPR) in the PTAB, or a patent case or proceeding in the International Trade Commission (ITC). Laser experts could also assist in product liability, malpractice, standard of care, and personal injury cases.
Laser expert witness case examples
Example matters that Cahn Litigation Services has searched for expert witnesses encompass:
- vascular laser therapy,
- cosmetic lasers for cosmetic procedures (e.g., for plastic surgery, and facelift procedures),
- cornea procedures and refractive surgery (i.e., PRK and LASIK surgery),
- medical devices used for dentistry,

- optical communications.
What litigation support work might a laser expert witness be expected to perform?
In a litigation scenario, a technical expert can expect trial court testimony, as well as other expert witness services such as deposition, expert testimony, research, authoring expert reports, and related consulting activities. In addition, a law firm may seek a laser industry expert for pre-litigation consulting work. In high profile cases, or litigation involving a significant financial stake, previous expert witness testimony experience is often a requirement.
Cahn Litigation Services has the experience required to turn a search for a laser expert witness around quickly, providing the right balance of expertise and testimony experience.
